Introduction

These Terms and Conditions (“Terms”) govern your use of the Poolsco Landscaping LLC website at poolscolandscaping.com and the services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Poolsco Landscaping LLC is a company registered in Dubai, United Arab Emirates, with offices at 208 Sultan Business Centre, Al Wasl Building, Oud Metha, Dubai.

Services

Poolsco Landscaping LLC provides the following services in Dubai and the wider UAE:

• Custom swimming pool design and construction
• Landscaping design and installation
• Hardscaping and stone works
• Softscaping and planting
• Pool and garden water features
• BBQ counters and outdoor kitchens
• Interior design
• Ongoing pool and garden maintenance

All services are subject to a separate written agreement, signed quotation, or project contract between Poolsco and the client. These Terms apply alongside any such agreements.

Quotations and Proposals

• All quotations provided by Poolsco are free of charge and carry no obligation.
• Quotations are valid for 30 days from the date of issue unless otherwise stated.
• A quotation does not constitute a binding contract. A project begins only upon receipt of a signed agreement and the agreed initial deposit.
• Final pricing is subject to site assessment and confirmation of scope. Any changes to the agreed scope of work may result in revised pricing, communicated in writing before proceeding.

Payment Terms

• A deposit is required to confirm and commence any project. The deposit amount and payment schedule will be detailed in the project agreement.
• Payments are due on the dates specified in the project agreement. Late payments may result in a suspension of works.
• All prices are quoted in UAE Dirhams (AED) and are inclusive of VAT where applicable under UAE VAT regulations.
• Poolsco reserves the right to apply interest on overdue invoices in accordance with applicable UAE commercial law.

Project Timelines

• Estimated timelines are provided in good faith based on project scope, site conditions, and material lead times at the time of quoting.
• Poolsco will communicate any changes to agreed timelines promptly and in writing.
• Poolsco is not liable for delays caused by factors outside our reasonable control, including but not limited to extreme weather, utility outages, HOA approval delays, third-party supply chain disruptions, or client-requested changes.

Client Responsibilities

The client agrees to:

• Provide accurate information about the property, existing infrastructure, and any known site constraints
• Obtain all necessary HOA, developer, or municipality approvals prior to or during the project, unless otherwise agreed in writing
• Ensure safe and reasonable access to the site during agreed working hours
• Notify Poolsco promptly of any concerns or requested changes during the project
• Make payments in accordance with the agreed schedule

Failure to meet these responsibilities may impact timelines and costs, and Poolsco will not be held liable for resulting delays or additional expenses.

Changes and Variations

Any changes to the agreed scope of work must be requested in writing. Poolsco will assess the impact on cost and timeline and issue a variation order for client approval before proceeding. No variation will be implemented without written agreement from both parties.

Warranties and Defects

• Poolsco warrants that all work will be completed to a professional standard using quality, UAE-appropriate materials.
• Any defects arising from workmanship or materials within the warranty period stated in your project agreement will be rectified at no additional charge, subject to proper use and care by the client.
• Warranty does not cover damage caused by misuse, neglect, accidental damage, unauthorised modifications, or normal wear and tear.
• Poolsco is a fully licensed and insured LLC. All works comply with Dubai Municipality regulations and safety standards.

Maintenance Services

• Maintenance contracts are governed by separate agreements that detail scope, frequency, and pricing.
• Either party may terminate a maintenance contract with the written notice period specified in that agreement.
• Poolsco is not responsible for damage caused by the client’s failure to follow care instructions provided at project handover.

Intellectual Property

All designs, drawings, concept plans, renderings, photographs, and content created by Poolsco Landscaping LLC remain the intellectual property of Poolsco unless explicitly transferred in writing. Clients are granted a licence to use project designs solely for their own property. Designs may not be reproduced, shared, or used for other projects without written consent.

Website Use

By using poolscolandscaping.com, you agree to:

• Use the website for lawful purposes only
• Do not attempt to interfere with the website’s operation or security
• Not reproduce, copy, or redistribute any content from the website without prior written permission

All website content — including text, images, logos, and project photography — is the property of Poolsco Landscaping LLC and is protected under UAE intellectual property law.

Limitation of Liability

To the fullest extent permitted by UAE law, Poolsco Landscaping LLC shall not be liable for:

• Indirect, incidental, or consequential losses arising from the use of our website or services
• Losses caused by circumstances beyond our reasonable control
• Damage to underground utilities, pipes, or cables that were not disclosed to us before the commencement of works

Our total liability in connection with any project shall not exceed the total amount paid by the client for that specific project.

Privacy

Your use of this website and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any dispute arising out of or in connection with these Terms or our services shall first be referred to good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

Changes to These Terms

Poolsco reserves the right to update these Terms at any time. The revised version will be published on this page with an updated effective date. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
